How Child Custody Cases are Determined

It is the dream of all youngsters to be of age to make their life choices. Besides getting an education and a career, another thing that every person is looking forward to has a family. When one is of age and ready to settle down, they look for their partners and get married to start a family. Children are perceived as a part of the family fundamental to making it whole and complete. Children are gifts for most people, and all parents want to have is blessed with some. Relationships are often faced with challenges, and most people will be left in chaos as they are unable to agree on something. Sometimes, these issues can get out of control to the point that the parents cannot see face to face with each other. As much as divorce and separation will affect the couple, the children will also be affected to some extent. Things are not easy when parents can only raise their children separately because that is mostly not what they wished for. Most parents end up solving their conflicts in the court of law when they have to go their separate ways and children are a part of their lives. These issues are left for the court to decide which of the parents is best to live with the child as both parents cannot share a roof. The primary thing that the court looks into is how the parent and the child relate. Like adults, children need to be with people they not only feel safe around but also those that can make them feel loved. A parent who has in the past neglected or abused the child in any way will be disregarded as fit for taking care of the child. Separation and divorce affect children a lot, and thus they need a place where they can talk and let their thoughts out; hence a parent they feel free about is vital.

Age is another thing that the court will take into account. Different children’s ages determine who takes their custody; the younger they are, the more possible it is for them to go with the mother.

The third thing the court will consider is how to fit the parent is to take care of the child concerning their behavior.

If the child’s mother is a stay-at-home mum, then the court will most likely give her custody, unlike when the parent is at work for the most part of their day.
